2. Within the Website, you may find links or references to third party materials and websites outside www.olliella.com. We do not endorse, authorise, or control those websites and therefore accept no liability in respect of the content or your use of those websites.
3. It is a condition of your using www.olliella.com that you have read and consented to the terms of our privacy policy. This tells you how we use your personal information.
4. Olli Ella Enterprises Pty Ltd makes no representations or warranties (express or implied) and we are unable to guarantee the accuracy of information on the Website. We do not accept any liability arising out of reliance on the materials on our Website.
5. We may terminate your access to our Website at any time if we decide at our sole discretion that you are in breach of these Terms.
6. We may change any aspect of www.olliella.com at any time without letting you know. You agree to be bound by such updates and you agree to visit this page from time to time to check such changes.
7. These Terms, our Privacy Policy, and our Terms and Conditions, which are all subject to Australian law, contain the entire agreement between us with respect to our Website. No part of these terms is intended to constitute an exclusion of any liability which cannot be excluded under Australian law.

Nothing contained on the Website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark displayed on the Website without written permission from Olli Ella Enterprises Pty Ltd or such third party that may own the trademarks displayed on the Website. By using the Website you agree to respect the intellectual property rights of Olli Ella and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for commercial purpose any material contained within the Website. You may, however, download material that is required for the sole purpose of assisting you in placing an order. Such downloaded material may not be used for any purpose other than to assist you in placing an order. You may not create any links to our Website from another Website without our written consent.

Order Confirmation

All orders for Goods are accepted when you receive a confirmation e-mail to this effect. We are legally obliged to send you this confirmation and you may wish to print or save it for your future reference. The confirmation will include details of your order, including your chosen delivery address. Delivery of Goods will be 6-8 weeks from date that the Order was placed. You will be contacted one to three days prior to delivery to arrange a delivery time.

Price and Payment

All prices are quoted in Australian Dollars (AUD) and, where appropriate, are inclusive of AU sales tax (GST) but exclusive of delivery charges. We try to ensure that all prices on display on the Website at www.olliella.com are accurate. The price of an item is the price at head office on the day of your order. We reserve the right to change any price after you place an order. Where Goods are discontinued or cannot for some reason be delivered we will contact you by e-mail or telephone to inform you of this. All payments must be in Australian Dollars. We accept payment by Visa, MasterCard. We will charge you as soon as your order has been placed.

Promo Codes

• Promo codes are valid for a limited time only, Olli Ella reserves the right to modify them at any time. 
• Promo code applies to qualifying items only. See the specific details of the promo code for excluded products. 
• Promo codes for abandon carts apply to RRP price and not valid on sale items or in combination with other offers.
• Our welcome promo code is for first time purchases, with a minimum order value of $50 and is valid on full priced items only.
• Promo codes cannot be applied to previously placed orders. 
• Promo codes do not apply to pre-orders, unless otherwise specified. 
• Promo codes do not apply to Gift Cards or Sale items, unless otherwise specified. 
• Promo codes are not transferable, may not be resold or redeemed for cash. 
• Only one promo code (including Loyalty Club Silver and Gold ongoing codes) can be used at a time and cannot be combined with other offers using promo codes.

Gift Cards

• Gift Cards may only be redeemed at the Olli Ella website.
• Gift Cards are not valid to be redeemed at any Olli Ella stockists.
• Gift Cards have no expiry date.
• Gift Cards are not redeemable for cash. 
• Olli Ella does not take responsibility for any lost Gift Cards.
• Gift card purchases do not form part of the free shipping threshold.

Sales

• Discounts will be retroactively considered on planned, advertised Sales (ie Mid-Year Sale and Black Friday Sales) only to purchases made within 24 hours of the sale. 
• Flash Sale - We will spontaneously go on sale from time to time. For any flash sale offer, discounts will be retroactively considered  only to purchases made within 24 hours of the sale.

Cancellation and Returns

Please note that we are be unable to cancel orders, change shipping methods or product after an order has been made.

We offer refunds or 100% store credits, if the merchandise:

• Is returned within 30 days of order delivery 
• Was not purchased with sale price (excluding apparel items)
• Has not been used or worn
• Is not soiled or damaged 
• Has original packaging and tags
• Return authorisation number has been issued

If all of these conditions are met, please use the following instructions when requesting return product:

• Go to https://olliella.com/pages/returns to lodge your return via our Returns Portal. Please explain reason for return, request a credit note or refund, and reference your order number. If you are claiming a faulty item, please include photos supporting your claim.
• Once return has been authorised, you will be issued with a return postage label. Please return product in original packaging along and return within 30 days of receiving your order.

Packages received after this period will not be accepted. We suggest using a tracked service as we are not responsible for any goods lost in transit.

Once we receive returned goods and they prove to be in original condition, with packaging and documentation, we will process the credit note refund. Please note that Olli Ella is not responsible for transit costs for returned items. These are at the customer's expense unless the item has a fault.

Where a credit note is issued, it will be at 100% of your order value. Credit notes will be sent via email once your return has been processed, it will then be available to use immediately through our online store. 

Faulty or damaged items can be returned by following the above process. Please contact questions@olliella.com

Please note, shipping costs, sale items and gift-certificates are non-refundable.

Limitations of Liability

We will use all reasonable endeavours to carry out our obligations within a reasonable period of time but will not be liable to you for any loss, costs or expenses arising directly or indirectly from any delays in doing so and we will not be deemed to be in breach of these terms and conditions by reason of any delay in performing, or any failure to perform, any of our obligations in relation to these terms and conditions, if the delay or failure was due to any cause beyond our reasonable control. Except in respect of death or personal injury caused by our negligence, we will not be liable to you for any economic loss, which term shall include loss of profits, business, revenue, goodwill or anticipated savings or any special, indirect or consequential loss in connection with the supply of the Goods.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of NSW, Australia. Any disputes concerning this website are to be resolved by the courts having jurisdiction in NSW.

We retain the right to bring proceedings against you for breach of these Terms and Conditions, in your country of residence or any other appropriate country or jurisdiction.

Mobile Terms of Service

The Olli Ella UK mobile message service (the "Service") is operated by Olli Ella UK (“Olli Ella UK”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Olli Ella UK’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Olli Ella UK through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Olli Ella UK. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Olli Ella or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Olli Ella UK mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
